This unique coursebook attempts to recreate for law students the experience that lawyers have when analyzing the procedural issues involved in the investigatory phase of a criminal case. This approach not only enhances learning but also makes learning enjoyable since students get to play lawyer.

At the outset of each chapter, a complex problem is presented in the form of a memo to a law clerk working in a variety of settings (reporting to a public defender, prosecutor, judge or private criminal defense attorney). The problem is followed by the research tools–relevant cases and statutes–necessary to solve the problem. Notes follow many cases, suggesting to students how the cases might be used to analyze the problem. They also contain summaries of recent cases which may give students a broader perspective on how courts are handling the issues raised by the main cases.

This book focuses on criminal procedure under the United States Constitution. Cases are edited sparingly, and many dissents and concurring opinions are included. The cases are presented in chronological order within a topic so that students can see how doctrines or laws developed historically.

“When the Army developed the Active Defense strategy in 1976, the US was facing the Cold War scenario of central Europe. Military strategy and doctrine were related to a single, focused threat that revolved around the countries in the Warsaw Pact. We were an outnumbered and technically inferior force facing an armor-dominated European battlefield. The MP Corps supported the Active Defense strategy by tailoring its forces to meet the threat. In 1982, when the AirLand Battle strategy was developed, US forces were still outnumbered, but were no longer technically inferior. Still threat-based and focused on a central European conflict, the AirLand Battle strategy used a relatively fixed framework suited to the echeloned attack of soviet-style forces. It delineated and clarified the levels of war; emphasized closed, concerted operations of airpower and ground forces; balanced the offense and the defense; and highlighted the synchronization of close, deep, and rear operations. MP doctrine kept pace with the Army’s AirLand Battle strategy by supporting the battlefield commander through four basic missions—battlefield circulation and control, area security (AS), enemy prisoner of war (EPW), and law and order (L&O).”

The military police component addresses this interest through the PIO function, which includes a review of the environment in a holistic approach, analyzing both the criminal threat and the capabilities of existing law enforcement agencies. This review is an assessment of the criminal dimension when considering the civil environment in mission, enemy, terrain and weather, troops and support available, time available, and civil considerations. PIO are a military police function that supports, enhances, and contributes to a commander’s situational understanding and battlefield visualization and FP programs by portraying the relevant criminal threat and friendly information, which may affect his operational and tactical environment. They are a function (consisting of systems, processes, and tools) that capitalizes on military police capabilities to analyze police information and develop criminal intelligence through the integration and employment of ALE assets and other police organizations. Like the military intelligence (MI) officer (intelligence staff officer [S2] and assistant chief of staff, intelligence [G2]) uses the intelligence preparation of the battlefield (IPB) process to analyze the threat and the environment continuously in a specific geographical area, military police leaders use PIO to assist the G2 and to collect, organize, and analyze police information continuously as part of the IPB process. As described in this and later chapters, PIO contribute to the IPB; they are not a substitute for the IPB.
